A High Net-Worth Family’s Estate Dispute

CASE STUDY: HIGH NETWORTH FAMILY ESTATE DISPUTE

A family real-estate inheritance dispute resolved through mediation

The patriarch of a large mega-rich family passed away unexpectedly in a traffic accident. The will, drafted many years ago, failed to cover much of the property and wealth under his name. This led to a major dispute between the patriarch’s wife and children against his siblings and their children – all of whom worked in one of the many companies the patriarch had founded, and lived on property paid for by those companies.

Working closely with the advocates of each side, Aloysius methodically grouped the estate into a few major lots before defining the value of each lot with both sides. The parties had a chance to speak about their emotional ties to some of the property and explain why they were prepared to give up more valuable lots in exchange for those deemed sentimentally more important.

The mediation also provided a powerful opportunity for the younger generation to greet their elders and for an open and respectful sharing of how they each wished, in their own different ways, to fulfil the patriarch’s wishes as had been expressed to them separately.
